We provide legal support for a wide range of airport, transit, and roadway development activities, including construction contracting for a variety of project delivery methods and involving AIA forms, professional services contracting, bid protests, contractor claims and disputes, dispute resolution processes, construction litigation, procurement, contracting to acquire technological systems, OCIP programs, LEED compliance issues, land use and airspace issues, and addressing community impacts. This includes support for regulatory issues affecting development, such as DBE requirements in construction contracting, state and federal Relocation Act requirements, and property acquisition issues involving condemnation and land use.

Aviation Representation

Our extensive aviation services include advice and representation for a full spectrum of federal and local issues. We have broad experience with airport regulatory requirements, such as proprietors’ rights; federal grant assurance requirements, including revenue diversion and exclusive rights; minority participation programs, such as DBE and ACDBE requirements; minimum standards for aeronautical activities; aviation security and police measures; grant and passenger facility charge issues; Part 16 issues; and local governance and regulatory matters. Our work includes federal, state, and local lobbying efforts. We provide legal support for negotiating airport use and lease agreements, concession contracts for a full spectrum of airport concessions, management agreements for parking and other facilities, ground leases, tenant development lease agreements, third-party development agreements, FBO agreements, office space leases, technology agreements, licenses and permits for airport services and activities, and intergovernmental agreements supporting airports. Our services also support an airport’s commercial business needs, including tenant evictions, commercial disputes and litigation, impounding tenant aircraft, and tenant bankruptcy support.
